Dr Augusto Zimmermann teaches legal theory and constitutional law at Murdoch University in Western Australia. In this interview with the ACL's Katherine Spackman, Dr Zimmermann says that the Family Law Act that was introduced in 1975 to allow no-fault divorce has created an unjust system where irresponsible and selfish behaviour is not considered in settlements. He says in no other legal contract does the law reward irresponsible behaviour. He says the Family Law Act should be amended - not to remove no-fault divorces - but to remove the incentives of no-fault divorce which allows a spouse to leave a marriage without any fear of losing custody of children and property.
