Protection of Unborn Children in SA
Around 5,000 abortions occur in South Australia each year, including dozens after 22 weeks of pregnancy. The law allows abortion on request up to 22 weeks and 6 days, and permits later procedures for wide-ranging reasons. These laws shape how the state treats some of its most vulnerable children, yet many South Australians remain unaware of the extent of late-term abortion in their state.
There is a growing desire for laws that reflect greater care for unborn children and offer real support to women facing difficult pregnancies. This page provides an overview of recent pro-life reform attempts in the Legislative Council (South Australian Upper House) and the voting record of Members of the Legislative Council (MLCs) to help inform you as you prepare to vote in the 2026 State election.
RECORD OF PRO-LIFE BILLS IN SA
Since the removal of all gestational limits on abortion in 2021, 79 healthy South Australian babies have been killed in the third trimester (post 23 weeks’ gestation) through feticide for social or mental health reasons of the mother.
These recent narrow losses highlight our hope but also how critical it is to elect pro-life MPs who will stand for children in the womb.
With the March 2026 state election approaching, only one more pro-life voice in the Upper House could be the difference in bringing South Australia closer to legislating for life.

Termination of Pregnancy (Restrictions on Terminations after 22 weeks and 6 Days) Amendment Bill 2025 ‘Viable Babies Bill’
In September 2025, Hon. Sarah Game MLC introduced the Termination of Pregnancy (Restrictions on Terminations after 22 weeks and 6 Days) Amendment Bill 2025 ‘Viable Babies Bill’. This pro-life Bill would have prohibited late term abortions (when a baby is at more than 23 weeks’ gestation) for social or mental health reasons. The proposed changes aimed to protect viable unborn children. On 12 November, this Bill was voted on in the Legislative Council and lost by two votes.

Termination of Pregnancy (Terminations and Live Births) Amendment Bill 2024 ‘Live Births Bill’
Last October 2024, Hon. Ben Hood MLC introduced a Bill in a similar vein, the Termination of Pregnancy (Terminations and Live Births) Amendment Bill 2024 ‘Live Births Bill’. It sought to ensure that viable babies from 28 weeks’ gestation would be born alive rather than killed through feticide through an early delivery of labour (if the woman insisted on ending the pregnancy). This would effectively have ended the practice of late-term abortions, where the current practice administers a lethal injection to the baby before then delivering them deceased. Tragically, this life-saving Bill failed 10–9 – only one vote short on 16 October 2024.
