Same-sex marriage should go to the people
Kevin Rudd's public humiliation of Christian Pastor Matt Prater on Monday night's Q&A is yet another reason why a referendum of the Australian people may be needed to settle the issue of same-sex marriage.
As the nation's leader, the PM was giving powerful permission for the ostracising of those who wish to hold to the definition of marriage as between one man and one woman.
For those whose conscience will always cause them to hold this view, it was chilling to watch. And this is before one jot or tittle of the Marriage Act has been changed.
Parliamentarians should not be put in the position of having to decide if this is how their fellow Australians are to be treated once the law of the land is changed.
The law is a powerful instrument and emboldened by it, some will use it as a big stick to further silence those who wish to speak up publicly for man-woman marriage.
What was also profoundly disturbing about Monday night was the two different Mr Rudd's on display.
Earlier that evening I hosted ACL's own Q&A-style election panel which featured former Rudd Government Attorney-General Robert McClelland and former deputy prime Minister John Anderson.
ACL webcast the event live to more than 300 churches at 7:30pm, kicking off with exclusive video messages from Mr Rudd and Opposition Leader Tony Abbott.
Mr Rudd's pitch to Christian voters was gracious and respectful. While he knew most of the webcast audience was disappointed by his change on marriage, he earned points for his conciliatory tone as he admitted this.
He even went so far to say that it was okay for Christians to disagree with him in "equal prayerful conscience".
By 10:30 when many of us arrived home and tuned into the ABC's Q&A we were just in time to see Mr Rudd's "prayerful conscience" approach to tolerance going out the window.
We saw a glimpse of what freedom of speech and freedom of belief might look like in the future as Pastor Matt Prater was mocked by the crowd.
But there are also constitutional reasons why same-sex marriage should go to a referendum.
Earlier in the evening, Mr McClelland reminded webcast viewers that when he was Mr Rudd's Attorney-General in 2008 he removed all discrimination in Australian law against same-sex couples. This was supported by ACL.
He said same-sex marriage was not a legal but a definitional issue.
"I think the High Court will ultimately, if there is a change in the law, be required to determine what the constitutional founders meant when they included the marriage power in the constitution.
"I don't think that's a comfortable place for the High Court to be. I think if there is going to be any reform in this area, and I don't think there should be, but if there is it should be through the public debating it through the course of a referendum."
Mr Anderson agreed saying he was "deeply troubled by the lack of civility" in the debate.
"I think this debate puts politicians under unbelievable pressure because the community is so polarised.
"I actually think this now needs to go the people".
Mr Anderson was quick to say that despite his Scottish heritage a referendum should come with a "publicly funded, properly articulated yes and no case".
He said there should also be an honest acknowledgement of what changing the law on marriage would mean for freedom of belief and the right to express that belief.
He also said there was another vexed issue.
"Same-sex marriage does lead to same-sex parenting and there is a huge issue in my view of the state sanctioning the idea that a certain class of children will be denied access to one or other of their biological parents."
The people should certainly have a say on this.
But perhaps a constitutional referendum won't be needed.
Until Mr Rudd's blasting of Pastor Prater, he and Labor had been relatively quiet on the issue for the past few weeks.
This was despite a flourish at the beginning of the election campaign when Mr Rudd put it front and centre with a bold promise to legislate within 100 days if Labor was re-elected.
As the polls dropped so did Mr Rudd's rhetoric on same-sex marriage.
Pollsters say it hardly rates as an issue in focus groups and it is a fair bet that political strategists on both sides of politics know this.
If the Coalition wins, it can rightly assess that this election was in part a referendum on same-sex marriage.
Legal recognition for same-sex couples has already been achieved. We don't need to change the marriage law so that political correctness can be forced on people like Matt Prater.
If same-sex marriage advocates persist after Saturday, it should go to the people – again.
MR: ACL urges vote for candidates who support man-woman marriage

The Australian Christian Lobby will email 100,000 people the views of their local candidates on marriage in the lead-up to the election.
ACL Managing Director Lyle Shelton said he had emailed ALP and Coalition candidates and as many minor party candidates as possible seeking their views.
“We will be doing our best to let as many people as possible know where their local candidate stands.
“We will be urging people to vote for a candidate, regardless of party affiliation, who will support upholding the definition of marriage,” Mr Shelton said.
“Changing marriage does not have to be inevitable and the election is an opportunity for people to make their views known in the privacy of the polling booth.”
In the past 11 months, same-sex marriage bills had been defeated in the Federal, Tasmanian and South Australian parliaments.
Mr Shelton said the Australian Christian Lobby supported the Rudd Government’s removal in 2008 of invidious discrimination against same-sex couples and was pleased two parliamentary inquiries found there was no practical discrimination in Australian law against same-sex couples.
“There is no reason to change the definition of marriage," he said.
“Changing the definition of marriage means we are saying as a society that marriage between a man and a woman is no longer an ideal nor an essential building block for raising children to know the love and nurture of their biological parents.
“This is a radical change in our social norms and one that should not be undertaken lightly.
“Equal love might be fine for adults but changing the Marriage Act has ramifications far beyond same-sex couples.
"The perceived benefit in redefining marriage doesn't outweigh the impact it will have on society's understanding, value and role we place on man-woman marriage," he said.

We know that proponents of redefining marriage are putting pressure on Tony Abbott to allow a conscience vote for his party. Please write and ask him to maintain party discipline on the definition of marriage being between a man and a woman, which reflects their party policy, and to not allow a conscience vote.
In 2012, the House of Representatives and the Senate rejected two bills that sought to change the Marriage Act to include same-sex couples. There is no doubt the response from so many of you in signing petitions, emailing your MPs and Senators and visiting them had a tremendous impact in this result.

MR: Decisive Senate votes 41-26 in favour of keeping the Marriage Act intact

Australian Christian Lobby Managing Director Jim Wallace said today’s 41-26 vote in the Senate against same-sex marriage means the Parliament has now expressed a decisive view on the matter.
“The Greens should respect the wishes of the Parliament and drop their remaining two bills.
“Everyone has had enough of this debate,” Mr Wallace said.
“It has been one of the most vitriolic campaigns I have ever seen and it has demonised so many good people out of the public square, such as Victoria’s chief psychiatrist Kuravilla George, who lost his job as a member of Victoria’s Equal Opportunity Commission because he supported marriage.”
Mr Wallace repeated calls for Attorney General Nicola Roxon to defend the Commonwealth Marriage Act against Greens moves in State Parliament to introduce competing same-sex marriage bills.
“It is not in the interests of the nation to have a hodge-podge of marriage laws.
“The Greens and gay activists should respect the Commonwealth’s marriage power instead of continually abusing the processes of state and territory legislatures to achieve a rolling campaign for homosexual marriage.
“They have had a fair go, it is time to move on,” Mr Wallace said.
Same-sex marriage defeated 98-42, see how your MP voted

A bill to change the definition of marriage was defeated by 98-42 in Parliament’s House of Representatives yesterday.
A second bill in the Senate is expected to be voted on tonight and by all accounts will also fail.
The events this week in Canberra should draw a line under what has been a long campaign by activists to overturn the definition of marriage.
There is no doubt the response from so many of you in signing petitions, emailing your MPs and Senators and visiting them has had a tremendous impact in this result.
Participating in democracy is effective. Thank you for your great work over the past couple of years in responding to many calls to act at strategic times during the campaign.
The Coalition under Tony Abbott has shown great integrity in keeping its election promise to vote together against changing the Marriage Act.
Despite making the same election promise, 38 Labor MPs voted for Labor member Stephen Jones’ private members bill to change the definition of marriage.
We have listed how MPs voted below, along with the email addresses of those who voted to uphold marriage. Please thank them.
Now that the vote has been held, it is time to move on and ACL is looking forward to focussing fully on our core business of encouraging the Christian constituency to bring Christian influence into government across a wide range of issues of justice and righteousness.
Marriage has been in trouble for generations, quite independently of gay activists’ attempts to redefine it. We all have a responsibility to promote its good, especially for children, and to help our society again fall in love with this most important of human relationships.

On Monday, Federal Senators began the debate on the Marriage Amendment Bill (No.2) 2012. The bill calls for the amendment of the
Marriage Act 1961
to enable same-sex marriages to be recognised. The current definition of marriage as outlined in the
Marriage Act 1961
is “the union of a man and a woman to the exclusion of all others, voluntarily entered into for life.” Should the Marriage Amendment Bill be passed, the words “a man and a woman” would be replaced with “two people” to remove the gender-specific reference of marriage partners.

On Saturday 15 September, ACL's Managing Director Jim Wallace and ACL Victorian Director Dan Flynn were among the guests of His Grace Bishop Suriel at the grand opening of the Saint Mina & Saint Marina's Coptic Church in Hallam, Victoria. Guests included numerous Federal and State MP's and Councillors from the City of Casey.
In March 1993, the late Coptic Pope visited the site in Hallam to lay the foundation stone and famously declared that "just as our Lord Jesus Christ was born in a manger, so too we will build the church in this cattle shed".
The unrelenting efforts of the congregation has resulted in the completion of a $6 million three story church which is a prominent landmark in the City of Casey. The new church is the home parish to approximately 600 families. Many of these families have recently arrived in Melbourne after fleeing persecution in Egypt.
Father Abanoub Attalla, the Parish Priest of St Mina & St Marina, was warmly acknowledged for his pastoral leadership of the families and youth of the Coptic community in Hallam and integration of Egyptian refugees. Presenting the inaugural "Key of the City of Casey" to Bishop Suriel, the Mayor of Casey, Cr Sam Aziz praised him for his strength of leadership and example saying he had showed courage in standing “ against those whose superficial quest for so called political correctness constantly outweighs their moral integrity".
In keeping with these convictions, Bishop Suriel has been a prominent supporter of traditional marriage and recently signed a statement delivered to the Federal Parliament, together with 19 of Australia's denominational leaders and 267 other church leaders, urging the Parliament to protect the Marriage Act. The statement says:
"Marriage is the lifelong commitment and faithful union of one man and one woman. As such, marriage is the natural basis of the family because it secures the relationship between biological parents and their children."

With Parliamentary debate on marriage beginning again tomorrow in Canberra, 19 of Australia’s denominational leaders and 267 other church leaders have urged the Parliament to protect the Marriage Act.
The leaders have signed a joint statement calling for the Act to remain unchanged.
There are four bills to change the definition of marriage before the Parliament, two of which are expected to be voted on in coming weeks.
“Marriage is the lifelong commitment and faithful union of one man and one woman. As such, marriage is the natural basis of the family because it secures the relationship between biological parents and their children,”
The statement says.
Joint Statement on the Significance of Marriage
Marriage is the lifelong commitment and faithful union of one man and one woman. As such, marriage is the natural basis of the family because it secures the relationship between biological parents and their children.
As Christian leaders representing different denominations or churches, we join together and affirm our shared commitment to promote and protect marriage. We honour the unique love between husbands and wives; the vital place of fathers and mothers in the life of children; and the corresponding ideal for all children to know the love and role modelling of a father and mother.
Marriage thus defined is a great good in itself, and it also serves the good of others and society, as it has done for thousands of years. The preservation of the unique meaning of marriage is therefore not a special or limited interest, but serves the common good, particularly the good of children.
We call on Parliament to:
protect this definition of marriage in Australian law, and
not change the meaning of marriage by adding to it different kinds of relationships.
